Are cryptocurrency payments for property allowed under UAE AML rules?

Cryptocurrency and other virtual assets are not prohibited as a means of paying for UAE property, but they attract heightened AML obligations. The Ministry of Economy’s Circular 5 of 2022 specifically addresses freehold transactions where a virtual asset is used for part or all of the property value, and those where the funds were converted from a virtual asset before completing the purchase. In each situation the broker must file a Real Estate Activity Report through goAML, regardless of the AED 55,000 cash threshold that applies to ordinary cash deals.

Virtual-asset payments carry elevated laundering risk because value can move across borders quickly and pseudonymously. Brokers should therefore apply enhanced scrutiny: identify the buyer and beneficial owner, establish which wallet or exchange the funds originated from, and confirm the conversion trail into fiat currency where relevant. Where the origin cannot be satisfactorily explained, a Suspicious Transaction Report should be filed.

Agents must also record the identification documents, contracts and payment evidence for these deals and retain them for the statutory period.

AML regulations for real estate agents in the UAE

There is no prohibition on virtual asset payments in the AML law itself, but a broker who accepts one takes on a set of obligations it must actually be able to discharge. The customer due diligence duty is the same as for any other payment method: identify and verify the customer and the beneficial owner, understand the purpose of the relationship, and establish the source of the funds. Where funds arrive as virtual assets, the source of funds question extends to the wallet and the exchange behind it.

Two practical constraints matter. Whether virtual assets may be used as consideration in a property sale, and whether the developer or land department will register a transfer paid for that way, are questions for the property and licensing regime rather than the AML law. Separately, exchanging or transferring virtual assets as a business is a regulated virtual asset activity, so a broker must not drift into converting a buyer’s crypto itself. Treat a crypto-funded purchase as a higher-risk relationship, apply enhanced due diligence, and document how you satisfied yourself about the origin of the assets.
