Yes. The AML/CFT obligations under UAE law apply to a real estate broker because of the activity carried out, not the size of the business. A sole practitioner or small brokerage that concludes purchase and sale transactions for clients is a Designated Non-Financial Business or Profession and must register on goAML, appoint an AML compliance officer, conduct an enterprise-wide risk assessment, perform customer due diligence, screen against sanctions lists, file REAR and suspicious transaction reports, and keep records for five years.

What can scale with size is how the controls are implemented. The risk-based approach lets a small firm design proportionate policies and procedures rather than replicate the compliance function of a large agency, provided the core obligations are met. A sole practitioner may combine the compliance officer role with their own duties, but the substantive obligations, and the penalties for failing them, are the same. Supervisors expect proportionate but genuine controls, not the absence of controls.

Yes. The obligations attach to the activity, not to the size of the firm. A sole practitioner concluding transactions or settlements on behalf of customers relating to the purchase or sale of real estate is a DNFBP in the same way a large brokerage is.

What scales is the response, not the duty. Internal policies, controls and procedures must be proportionate to the identified risks and to the nature and size of the activities, which gives a small brokerage room to run a simpler framework. But the required elements remain: customer due diligence measures, procedures for reporting suspicious transactions, compliance management arrangements including a compliance officer at management level, employee screening for fitness and propriety, capability-building programmes, and an independent audit function to test whether the controls work.
