What are the penalties for real estate brokers who breach UAE AML rules?

Real estate brokers who fail to meet their AML obligations in the UAE face administrative penalties from their supervisor and, in serious cases, criminal liability. The regime is designed to make non-compliance costly and to protect the integrity of the property market.

Administrative penalties can range from a written warning to fines and, at the most severe level, restriction or revocation of the licence to operate. Supervisory fines under the AML law can reach several million dirhams per violation, and specific breaches such as failing to file a suspicious transaction report or missing a required Real Estate Activity Report can each attract penalties. Where a broker knowingly participates in laundering, criminal penalties including imprisonment and substantial fines may apply. Regulators also publish enforcement actions, which brings reputational damage on top of the financial cost. Maintaining a documented AML programme, timely reporting and up-to-date records is the most effective way to avoid these outcomes.

AML regulations for real estate agents and brokers in UAE

Breaches expose the brokerage to administrative fines from its supervisory authority of between AED 10,000 and AED 5,000,000 for each violation. The supervisory authority can also act against the licence itself, including suspending, restricting or revoking the registration or listing, and can impose other measures short of that. Because the fine is assessed per violation, a systemic failure across a book of transactions multiplies quickly rather than attracting a single penalty.

Tipping off is treated separately and more seriously. Disclosing to a customer or anyone else that a suspicious transaction report has been or is about to be submitted, or that an investigation is underway, is prohibited outright. Where a broker goes further and deals with property knowing it to be criminal proceeds, that is the money laundering offence itself, which carries imprisonment and a fine on the criminal scale rather than an administrative one. The practical protection is a documented file: what you checked, what you were told, and why you were satisfied.

· Federal Decree-Law No. 10 of 2025, Article 17, which provides for administrative fines of not less than AED 10,000 and not more than AED 5,000,000 for each violation.

· Cabinet Resolution No. 134 of 2025, Article 19(1), which prohibits disclosing to the customer or any other person that a suspicious transaction report has been or will be submitted.

· Federal Decree-Law No. 10 of 2025, Article 26, which sets the criminal penalty for the money laundering offence itself.
